T-money Onda User Agreement
Chapter 1: General Provisions
Article 1 (Purpose)
These terms and conditions (hereinafter referred to as the "Terms") govern the use of the T-money Onda (hereinafter referred to as the "Service") provided by T-money Co., Ltd. (hereinafter referred to as the "Company") and the rights and obligations of the Company and the Members who have entered into a service contract with the Company in order to use the T-money Onda mobile application (hereinafter referred to as the "App" or "Web").
Article 2 (Application of Terms)
The Terms and the notices posted on the App or Web, including the Service Operation Policy, apply to Members.
Article 3 (Definition of Terms)
The following terms used in these Terms shall have the following meanings, and any terms not defined in these Terms shall be interpreted in accordance with the meanings commonly used by the Company in its service-related materials and business materials, or in the absence of such meanings, in accordance with the relevant laws and regulations.
- "Service" refers to a location-based taxi ride-hailing service that allows Members to call a taxi from a desired location through the App or Web and check the location of the taxi (driver).
- "Member" refers to a customer who has subscribed to the Service provided by the Company and agrees to these Terms and uses or intends to use the Service provided by the Company.
- "Safety Message Service" refers to a service that notifies the Member's designated mobile phone and SNS of the taxi ride information using the Member's taxi ride information.
- "Affiliate Service" refers to a service provided by an affiliate of the Company (hereinafter referred to as the "Affiliate") through the App or Web.
- "Auto-payment" refers to a payment method in which the Member's fare and fees (hereinafter referred to as "Usage Fee") are automatically paid without additional authentication each time the Usage Fee is incurred.
- "On-site payment" refers to a payment method in which the Member pays the Usage Fee directly at the scene of the ride (cash, card, etc.) instead of using an auto-payment method.
- "Coupon" refers to a discount voucher that can be used to receive a certain amount or percentage off the fare or Usage Fee of the Service.
- "Paid Service" refers to a T-money Onda service in which the Member pays the fare, fees (hereinafter referred to as "Usage Fee") to the transportation provider, the Company, etc.
Article 4 (Effect and Amendment of Terms)
- These Terms shall apply to all Members who wish to use the Service.
- These Terms shall come into effect when the Company posts the contents of these Terms on the App or Web screen or notifies the Members in any other way, and the Member agrees to them.
- The Company may amend these Terms to the extent that it does not violate relevant laws and regulations.
- When the Company amends the Terms, it shall notify the effective date and the reason for the amendment in the same manner as set forth in Paragraph 2, at least 7 days before the effective date. However, in the case of an amendment that is disadvantageous to the Member, the Company shall notify the Member at least 15 days before the effective date by at least two methods, including text message, PUSH, and homepage (taxi.tmoney.co.kr), among others. (If it is difficult to notify the Member individually due to the Member's failure to provide contact information or changes, etc., such notification shall be deemed to have been made individually by posting this notice.)
- If a Member does not agree to the Terms amended in accordance with Paragraph 4 of this Article, the Company may suspend the use of the Service and terminate the service contract. However, if the Company clearly states in the notice or notification that "if you do not express your intention to refuse by the date of the amendment of the Terms, you will be deemed to have agreed to the amendment of the Terms" and the Member does not explicitly express its intention to refuse the amendment of the Terms, the Member shall be deemed to have agreed to the amended Terms.
Article 5 (Supplementary Provisions)
Matters not specified in these Terms shall be governed by the relevant laws and regulations and the detailed service guidelines set by the Company.
Chapter 2: Use of the Service
Article 6 (Method of Using the Service)
- The Member's service usage effect shall occur when the Member installs the App on the mobile phone terminal or accesses the Web in accordance with the procedures set by the Company and agrees to these Terms.
- The Member may apply for the use of the additional service separately from the safety message service, and the application procedure, eligibility for application, and scope of service use shall be governed by the service guide.
- Members who wish to use auto-payment can use auto-payment according to the registration/connection method for each payment method.
Article 7 (Use of the Service)
- The Service is available 24 hours a day, 7 days a week, in principle, and the service fee may change according to the operating policy. The operating policy, specific service types, service fees, and other details are set forth in the service guide and notices on the App or Web.
- In the case of paid services, the Member's consent is obtained each time the service is requested, and the data communication charges incurred when using the wireless service are subject to the policy of each mobile carrier to which the Member has subscribed.
- The Service may be temporarily suspended for business or technical reasons, and may be temporarily suspended for a period determined by the Company for operational reasons. In such cases, the Company shall notify the Member in advance, and if it is unavoidable to notify the Member in advance, it shall notify the Member promptly after the fact.
Article 8 (Use of Coupons)
- The Company may provide coupons to Members that can be used to receive a certain amount or percentage off the fare or usage fee of the Service in accordance with the Company's service policy, and the above coupons can be used for transactions of the fare and usage fee of the Service.
- Detailed matters regarding the provision and use of coupons shall be governed by the service policy determined by the Company, and the Company shall notify the Member of such matters through the Member app screen or a separate screen.
- Coupons can only be used with auto-payment.
- Coupons may be restricted in use depending on the type of taxi, payment method, amount, etc., and cannot be used after the expiration date.
- Coupons provided to Members cannot be used multiple times. However, this shall not apply if the Company sets a different scope of use, such as allowing multiple use, depending on the type and content of the coupon.
- If a Member withdraws from the Service or the service contract is terminated, any unused coupons held by the Member will be deleted and cannot be used. In addition, deleted coupons will not be restored even if the Member rejoins. However, in the case of coupons purchased by the Member for a fee, a refund request may be made in accordance with the policies of the Company and its affiliates upon withdrawal, and may be restored upon rejoining unless obtained in a manner prohibited by these Terms.
- Members may not lend, transfer, or sell coupons to others.
- If a Member acquires a coupon unfairly or illegally, the coupon cannot be used and the Company may revoke it.
Article 9 (Service for Minors Under 14 and Rights of Legal Representatives)
- The Company shall obtain the consent of the minor under 14 years of age and his or her legal representative before collecting, using, or providing the personal location information of the minor under 14 years of age (including the service provided to a third party designated by the user).
- The legal representative may exercise the right to reserve, withdraw, suspend, and request access and notification of consent to the collection, use, and provision of the personal location information of a minor under 14 years of age.
- If the Service provided by the Company cannot obtain the consent of the legal representative of a minor under 14 years of age for technical or policy reasons, the Company may restrict the use of the Service by the minor under 14 years of age. However, all disputes, lawsuits, and legal and factual disputes and responsibilities and costs related to all disputes, lawsuits, and legal and factual disputes arising from the Member's intentional or negligent input of incorrect information (age, etc.) shall be borne solely by the Member, and the Company shall not be held liable in any way.
Article 10 (Rights of Guardians of Children Under 8 Years of Age)
- In the following cases, the Company shall consider the consent of the guardian of the person (hereinafter referred to as the "child under 8 years of age") to the use or provision of the personal location information for the protection of the life or body of the child under 8 years of age as the consent of the person himself/herself.
- Children under 8 years of age
- Persons under limited guardianship
- Persons with mental disabilities as defined in Article 2(2)(2) of the Persons with Disabilities Welfare Act who are equivalent to severely disabled persons as defined in Article 2(2) of the Act on the Promotion of Employment and Vocational Rehabilitation of Persons with Disabilities (limited to those who have registered as persons with disabilities in accordance with Article 29 of the Persons with Disabilities Welfare Act)
- The guardian who wishes to consent to the use or provision of the "personal location information" of the child under 8 years of age for the protection of the life or body of the child under 8 years of age shall submit a written consent form with a document proving the guardian's status to the "Company".
- The guardian may exercise all of the rights of the child, the "user", if the guardian consents to the use or provision of the "personal location information" of the child under 8 years of age.
Article 11 (Protection of Personal Information, etc.)
The Company protects the personal information of its members in accordance with relevant laws and regulations so that they can use the service safely. The detailed contents of this policy are set forth in the posted Privacy Policy.
Article 12 (Cancellation of Service)
Members may cancel their use of the service through inquiries or the customer center. The Company shall process the member's service cancellation request immediately, unless there are special circumstances. If a member cancels the service, the additional service will be cancelled. If there are any arrears due to payment failure, the member may cancel the service after completing the payment.
Article 13 (Restriction and Suspension of Service Use)
If a member falls under any of the following categories, the Company shall notify the member in advance of the reason for and date of application of the restriction and suspension of service use. If the member does not make a separate explanation or express an intention to refuse by the application date, the Company may partially or completely suspend the member's service use or unilaterally terminate the service.
- Acts that damage or disadvantage the honor of others
- Acts of stating false facts in the application or change of use
- Acts of distributing information, sentences, figures, and sounds that violate public order and good morals to others
- Acts of registering or distributing computer virus infected data that causes malfunction or destruction of information, etc. of facilities related to the service
- Acts of distributing false information for the purpose of giving property benefits to oneself or others or causing damage to others
- Cases where the service is used falsely using the personal information of others or where the service use of others is interrupted
- Cases where the service is used in violation of laws and regulations
- Acts of unauthorized use or disclosure of personal information of others obtained in connection with the use of the service
- Other cases where the Company or others suffer civil or criminal damages due to illegal or unfair acts
Article 14 (Change and Suspension of Service)
- The Company may restrict, change or suspend all or part of the service to the member in any of the following cases.
- In case of unavoidable circumstances due to construction such as maintenance of system facilities
- In case of normal service use is interrupted due to power outage, failure of various facilities, or surge in usage
- In case the service cannot be maintained due to contractual problems such as termination of the contract with the affiliate company that recruits, manages and educates taxi operators and taxi operators in cooperation with the Company
- In case of other force majeure events such as natural disasters and national emergencies
- In case of service interruption under the preceding paragraph, the Company shall notify the members by means of public notice on the Internet, etc. However, in case of service interruption due to reasons beyond the Company's control (disk failure, system down, etc. without the operator's intent or negligence), the Company shall notify the members after the fact if prior notification is impossible.
Chapter 3 Use of Paid Services
Article 15 (Use of Paid Services)
- The Company shall provide information on the paid service to ensure that the member understands and can make transactions without mistakes or misunderstandings when using the paid service.
- The fare, usage fee, etc. that a member must pay when using the paid service vary depending on the content of the paid service used, and the Company shall provide detailed conditions of the paid service usage fee in the [Paid Service Details].
- A cancellation fee may be charged for using the paid service, and the Company shall provide detailed conditions of the cancellation fee occurrence condition and cancellation fee amount in the [Paid Service Details].
Article 16 (Use of Payment)
- Members can choose a possible method among "automatic payment" through the app or "on-site payment" where they pay directly on-site according to the service usage policy set by the Company to pay the T-money Onda service usage fee.
- If a member uses automatic payment, it is considered that the member has agreed to the following:
- A member who agrees to use automatic payment is considered to have expressed his/her intention to pay the T-money Onda usage fee without a separate authentication process.
- If a payment failure occurs due to problems with the validity, limit, etc. of the member's credit card, etc. at the time of automatic payment, it will be processed as a payment in arrears, and the service use of the member will be restricted until the unpaid amount is paid normally.
- In the case of an unpaid amount as in paragraph 2, the Company may proceed with a re-payment attempt using the payment method registered by the member without a separate notice to the member according to the policy set by the Company.
- If a payment failure occurs due to a system failure at the time of payment, the payment will be processed again without a separate notice to the member when the system is normalized.
- A member who wishes to use automatic payment must specify the payment method as automatic payment when calling a taxi. If a payment failure occurs due to problems with validity, balance, etc., it may be converted to on-site payment.
- In the event of a problem such as overpayment or duplicate payment due to reasons not attributable to the member, the Company shall refund all or part of the wrongly used usage fee based on the time when the normal service was provided. The Company shall, in principle, refund the same payment method as the payment method paid by the member, but if a refund using the same method is impossible, it may be refunded by other means such as cash.
Chapter 4 Rights and Obligations of the Company and Members
Article 17 (Obligations of the Company)
- The Company shall promptly process any complaints from members regarding the service, and if prompt processing is difficult, shall notify the member of the reason and processing schedule.
- The Company shall comply with laws and regulations related to the operation and maintenance of the service.
- If the Company has something to notify the member, it may notify the member by text message, PUSH transmission, or phone call to the mobile phone number provided by the member to the Company.
- In the case of a notice to an unspecified number of members, the Company may replace individual notices by posting them on the "app", "web", or homepage.
Article 18 (Obligations of Members)
- When providing and registering all information necessary for using the service, the member must provide and register complete information that matches the current facts, and must update it immediately if any changes occur.
- The member must manage the mobile phone terminal so that it maintains normal operation, and the Company shall not be responsible for any damages caused to the member due to the service not being provided normally due to the abnormal operation of the mobile phone terminal.
- Members shall not engage in any of the acts listed in each item of Article 12 when using the service.
- Members must comply with relevant laws and regulations, the provisions of these terms, service usage instructions, precautions posted on the "app" or "web", and matters notified by the Company, and must not engage in any other acts that interfere with the Company's business.
- The Company shall not be responsible for any disadvantages caused by the member's failure to provide the latest information to the Company in accordance with paragraph 1 of this article.
- Members must not misuse or counterfeit coupons without the company's consent.The company may cancel the member's purchase history or coupon accrual, restrict the issuance or use of coupons for the member, or expire or invalidate coupons issued due to misuse. In addition to the above measures, the company may also pursue civil and criminal liability against the member. If a third party files a lawsuit against the company or reports the member to the authorities, the member must indemnify and hold the company harmless from any and all liability. However, the company will be liable for damages caused to the member or a third party due to the company's intentional or negligent misconduct, within the scope of its liability.
Article 19: Information Provision
1. The company may display various information and advertisements (including those of the company and its affiliates) related to its services on the service screen.
2. Any communication or transaction between a member and an advertiser through the use of advertisements displayed on the service or participation in the advertiser's promotional activities through the service is entirely a matter between the member and the advertiser. In the event of any dispute between a member and an advertiser, the member and the advertiser shall resolve the dispute directly, and the company shall not be liable for any damages whatsoever. However, the company shall be liable for damages caused to the member or a third party due to the company's intentional or negligent misconduct, within the scope of its liability.

Article 21: Prohibition of Transfer
Neither the member nor the company may assign, delegate, or dispose of all or part of their position, rights, or obligations under these terms and conditions to a third party for the purpose of transferring, delegating, or providing security for the member's use of the service.
Article 22: Damages
1. If the company suffers damages due to the member's violation of relevant laws and regulations (such as the Road Traffic Act) or these terms and conditions, the member who violated these terms and conditions shall be liable for damages to the company.
2. If the company receives a claim for damages, a lawsuit, or any other objection from a third party other than the member in question due to the member's illegal acts or violation of these terms and conditions while using the service, the member in question shall indemnify and hold the company harmless at their own expense. If the company is not indemnified, the member in question shall be liable for damages to the company caused by such failure to indemnify. However, if the company's intentional or negligent misconduct causes damages to the member or a third party, the company shall be liable within the scope of its liability.
Article 23: Disclaimer
1. The company shall be exempt from liability for providing the service if it is unable to provide the service due to an unavoidable accident caused by a natural disaster or an equivalent event beyond the company's control.
2. The company shall not be liable for service disruptions caused by the member's fault. However, if the company's intentional or negligent misconduct causes damages to the member, the company shall be liable.
3. The company shall not be liable for any loss of expected profits by the member due to the use of the service. However, if the company's intentional or negligent misconduct causes damages to the member, the company shall be liable.
4. The member shall make the final judgment on the service and information obtained through the use of the service, and the member shall be solely responsible for the consequences.
Article 24: Dispute Resolution and Jurisdiction
1. If any dispute arises between the company and the member regarding the use of the service, the company and the member shall sincerely negotiate to resolve the dispute.
2. If the dispute is not resolved even after the negotiation under paragraph 1 of this article, either party may file a lawsuit with the court of competent jurisdiction under the Civil Procedure Act.
Supplementary Provisions
Article 1: Effective Date
These terms and conditions shall be effective from November 16, 2023.
