Subscription Terms and Conditions

 

Article 1 (Purpose)

The purpose of these Terms and Conditions is to define the rights, obligations, responsibilities, and other matters regarding members (hereinafter the “Subscribers”) who have subscribed to and paid for regular subscription services (hereinafter the “Regular Subscription Service”) whereby the Company guarantees the use of services for a set period of time at a discounted price in relation to the services provided by THE SWING Co., Ltd. (hereinafter the “Company”).

These Terms and Conditions take precedence over the Terms of Service and the Terms and Conditions for Personal Vehicle Rental, and apply only to Subscribers; provided that, the rights, obligations and responsibilities, etc., of members and the Company specified in the Terms of Service and the Terms and Conditions for Personal Vehicle Rental apply equally to Subscribers.

 

Article 2 (Definitions)

Major terms used in these Terms and Conditions shall follow the definitions used in the Terms of Service and the Terms and Conditions for Personal Vehicle Rental.

 

Article 3 (Subscription and Payment Method Regarding Regular Subscription Service)

Members can subscribe to the Regular Subscription Service by clicking the in-app button on the Regular Subscription Service sign-up screen (hereinafter the “Subscription Information Screen”). Members enter into a Subscription Agreement with the Company by selecting the subscription period and clicking the sign-up button, and the Subscriber allows the Company to charge him/her the subscription fee during the term of the Subscription Agreement at the price suggested at the time of purchase.

In the case where the Company notifies the automatic renewal of contract prior to signing the Subscription Agreement, the Subscriber’s subscription will automatically renew on the last day of the contract period unless it is terminated by the Subscriber him/herself or by the Company. If the Subscriber wishes to terminate the subscription, he/she should cancel the subscription in accordance with the method set forth in Article 4 of these Terms and Conditions before renewal on the last day of each period; otherwise, the subscription fee for the following month will be automatically charged through the credit card registered to the Company app by the Subscriber.

 

Article 4 (Cancellation of Regular Subscription Service)

Subscribers may cancel their subscription at any time by clicking the “Cancel Subscription” button (or buttons with a similar name) on the subscription service screen. When canceling a subscription, the subscription will remain in effect until the next payment date, which is when the subscription will expire by not being renewed.

 

Article 5 (Withdrawal of Subscription)

A Subscriber cannot cancel his/her subscription if the service has been used at least once since the first day of subscription or if three (3) days have passed since the first day of subscription. If the Subscriber has used the subscription less than once and wishes to withdraw within three (3) days from the first day of subscription, he/she may request withdrawal of subscription by contacting the Company’s Customer Center or clicking the “Cancel Subscription” button (or buttons with a similar name), and the Company shall refund the full amount within three (3) business days.

 

Article 6 (Change or Suspension of Subscription)

The Company is obliged to reasonably continue its operations to maintain Subscribers’ subscription benefits; provided that, in any one of the following cases, the Company may suspend its Regular Subscription Service, in whole or in part:

(1) In the event of reasons that occur or may occur, such as bad weather, natural disaster, war, riot, fire, industrial action such as strike, control by government agency, or other events beyond the Company’s reasonable effort;

(2) In the event where telecommunications service is not provided by a key communication service provider;

(3) In the event of maintenance, replacement or breakdown of information and communications facilities, including the Company’s system, or loss of communication;

(4) In the event where services provided through partnership with a third party are changed or suspended due to the circumstances of the affiliated business operator;

(5) In the event of reasons that significantly hinder the smooth operation of the Company, the Company shall not be liable for damages suffered by the Subscriber due to any change or discontinuation of the contents of Regular Subscription Service caused by any of the reasons listed above, unless such damages are caused by the Company’s intent or negligence.

 

Article 7 (Subscription Fees)

Detailed information regarding the monthly fees of Regular Subscription Service is provided in the application, and subscription fees are subject to change according to the Company’s fee policy.

 

Addendum

(1) These Terms and Conditions shall apply as of August 20, 2021.
